Justices will decide whether to consider the case

The U.S. Supreme Court will consider Friday whether to take up a lawsuit challenging President-elect Barack Obama's U.S. citizenship, a continuation of a New Jersey case embraced by some opponents of Obama's election.

The meeting of justices will coincide with a vigil by the filer's supporters in Washington on the steps of the nation's highest court.

The suit originally sought to stay the election, and was filed on behalf of Leo Donofrio against New Jersey Secretary of State Nina Mitchell Wells.

Legal experts say the appeal has little chance of succeeding, despite appearing on the court's schedule. Legal records show it is only the tip of an iceberg of nationwide efforts seeking to derail Obama's election over accusations that he either wasn't born a U.S. citizen or that he later renounced his citizenship in Indonesia.

The Obama campaign has maintained that he was born in Hawaii, has an authentic birth certificate, and is a "natural-born" U.S. citizen. Hawaiian officials agree.

Among those filing lawsuits is Alan Keyes, who lost to Obama in the 2004 Illinois Senate race. Keyes' suit seeks to halt certification of votes in California. Another suit by a Kentucky man seeks to have a federal judge review Obama's original birth certificate, which Hawaiian officials say is locked in a state vault.

Other suits have been filed by Andy Martin, whose case was dismissed in Hawaii, and by an Ohio man whose case also was dismissed. Five more suits, all later dismissed, were filed in Hawaii by a person who is currently suing the "Peoples Association of Human, Animals Conceived God/s and Religions, John McCain [and] USA Govt." The plaintiff previously sought to sue Wikipedia and "All News Media."

The most famous case questioning Obama's citizenship was filed in Pennsylvania in August on behalf of Philip J. Berg and sought to enjoin the Democratic National Committee from nominating Obama. The U.S. Supreme Court denied an application for an injunction and hasn't scheduled a conference on other aspects of the case. Earlier, a federal judge rejected it for "lack of standing"—ruling that Berg had no legal right to sue. In cases like this, judges sometimes believe the matter is best left to political institutions, such as the Electoral College or Congress, said legal scholar Eugene Volokh of the University of California at Los Angeles.

The remaining case with the highest profile is Donofrio vs. Wells. Because it was referred by Supreme Court Justice Clarence Thomas to other justices for conference, it gained undue importance for people unschooled in how the court works, Volokh said.

Many petitioners seeking stays of pending events have their cases distributed to the full court, he said. Problem here is, if you go by that standard of ignore the birth certificate, you immiediately deny citizenship to hundreds of thousands, if not millions of americans

1- Born during that period with only one American parent, on american soil

2- Born on american soil without american parents

3- Without birth certificates stating the country of origin of one parent.


By this standard, my mother, my grandfather and his siblings would all not be Americans. Hell, my citizenship would be called into question (for a different reason), even though I was born here to a mother who was (as far as she knew) a US citizen. Since they have (had) lived as Americans for who knows how many years, they are grandfathered in as American citizens.


The BS of this case not only hinges on the courts attempt at deciding an election, again, over the will of the people (which Bush v Gore clarified the conservative majority does not give a shit about), but it overrules lower court judges who have already said (in multiple districts), that :

1- Yes, he is a citizen;
2- The evidence against his citizenship is speculatory.
3- Private citizens have no standing to bring suits challenging citizenship of candidates on the ballot.

Seriously, how we live in a country where (and yes, Ill pick on Thomas, because he is the least qualified and most damaging justice in existence) one moron gets appointed to a position just because hes black, and goes about to prove that he is incapable of handling or functioning in that position without the coattails of those on the court he has made himself a subordinate to, but also does his damnest to undue the manifestations which (wrongfully) allowed him the chance at his position, but target those of his own people for irreverent, unfound and baseless legal discrimination, is beyond me!

How is this Thomas' fault? The court hasn't even decided to hear it; the motive ascribed for why he even referred the suit to the court is assumed to be malicious. Given that there's no, nada evidence for the basis of the suit, I'm going to assume it's so that the court can dismiss it and set an unambiguous tone: don't even bother deluding yourself that your bullshit citizenship lawsuits will get a friendly ear here.

I fucking hate that guy. Seriously, this guy had all the priviledge that he argues against, and didnt fucking deserve it. Meanwhile, regular non-self hating black folk like me go through life without affirmative action, earning shit the hard way, settling for second string. Whats more, hes a fucking dolt of a justice.

Im not saying I am the greatest thing since sliced bread, but really, there are college sophmores with greater independant thought and grasp of constitutional issues than Thomas.

WASHINGTON - The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth.

The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election. Donofrio says that since Obama had dual nationality at birth — his mother was American and his Kenyan father at the time was a British subject — he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.
